TERMS AND CONDITIONS
1) Legal information
Pursuant to Article 6 III 1° of the law n°2004-575 dated June 21, 2004, we inform you that:
- The websites, accessible from the URL www.ichay-mullenex.com and www.ichay-mullenex.fr (hereafter the "WebSite") is published by Ichay & Mullenex Avocats, Société d'Exercice Libéral à Responsabilité Limitée, a limited liability partnership under the laws of France, with a registered capital of 12.000 €, registered at the Paris Trade Registry under number D 478 088 081, located at 5 rue de Monceau, 75008 Paris, France, Phone number: +33 (0)1 42 89 19 80 - Fax number: +33 (0)1 42 89 14 99 (hereafter the "Law Firm").

2) Consent
By sending an e-mail to our Law Firm through a link available on the WebSite, by subscribing to our newsletter or by accessing and/or by using the WebSite, each individual (hereafter the "User") declares and warrants (i) that he/she has the legal competence and means to access and use the WebSite and (ii) that he/she has previously read the present terms and conditions and that he/she agrees to be bound by such terms and conditions without any conditions, modifications, and/or limitations.
The Law Firm declares using the Personal Data (as defined hereafter) for the purposes of sending:
- a newsletter,
- information on the events organized by and/or to which the Law Firm takes part in,
- information on the Law Firm's activity,
- information on legal news.
The Law Firm hereby undertakes not to transfer the Personal Data collected on the WebSite to a third party, except for its sub-contractors only allowed to process the Personal Data on behalf of the Law Firm exclusively, within the strict framework of the conditions defined herein. Moreover, the said sub-contractors will be bound by a confidentiality agreement prohibiting them from any other use of these Data. Nonetheless, the Law Firm draws the User's attention on the fact that the said sub-contractors could transfer these Data outside of the European Union within the framework of their assignment. Therefore, each User hereby agrees to the said transfer.
3) Privacy statements
Pursuant to Article 22 of the law n° 78-17 dated January 6, 1978, modified by the law n° 2004-801 dated August 6, 2004, the processing of personal data collected or posted on the WebSite has been notified in France to the Commission Nationale de l'Informatique et des Libertés under the number [pending procedure].
E-mail addresses and any other personal data (i) provided by the User by subscribing to the WebSite and/or the newsletter, or (ii) included by the User when communicating with the Law Firm and (iii) the User's IP (Internet Protocol) address related to his/her connection to the WebSite are the only personal data which may be collected and processed by the Law Firm through its WebSite (referred to together as the "Personal Data").
The Law Firm shall be granted the quality of controller for the processing of the Personal Data.
The Personal Data are recorded and used exclusively for the purposes mentioned in Article 2 here above. Consequently, the said data are kept on record and stored only for a duration proportional to the purpose of their collection and processing.
The User's IP addresses are recorded by the Law Firm exclusively for the purpose of discovering any malfunction of the WebSite, making safe such WebSite and/or the servers where the WebSite is hosted and using the data for statistical purposes without identifying the User.
Any User who proves his/her identity has the right to request that his/her Personal Data, as appropriate, are rectified, completed, updated or erased if they are inaccurate, incomplete, equivocal, expired, or in case their use or recording would be forbidden.

Personal Data relating to the members of the Law Firm which are given access to on the WebSite cannot be collected and processed without the prior and written consent of the individuals concerned. In particular, Users are not allowed to collect and process this data, whether automatically or manually, to send unsolicited commercial messages or any other kind of messages which would not have a direct connection with the activities of the Law Firm and its members.
4) Copyright
The WebSite and any work and content available on the WebSite, in particular any text, article, newsletter, brief statement, presentation, illustration, photograph, software, digital animation, etc., are and remain the exclusive property of the Law Firm, except for those owned by third parties which may be quoted on the WebSite (and identified with the mention "®" or "©" ).
The photographs reproduced on the WebSite are listed here when applicable. The intellectual property rights related to these photographs have been duly acquired by the Law Firm.
Users are only allowed to reproduce temporarily the WebSite in the cache memory of their personal computer for the purpose of facilitating the viewing of the WebSite.
Notwithstanding the previous paragraph, Users are not allowed to reproduce, represent, modify, translate and/or adapt, whether in part or in whole and whether for free or for a fee, the WebSite and any work and material composing the WebSite, and are not allowed to reproduce and/or represent such translation, adaptation and modification, whether in part or in whole, whether for free or for a fee, without the prior written consent of the Law Firm.
As an exception to the foregoing, the Law Firm grants to Users the right to download on their personal computer the newsletters and all other documents which are made available to the Users, in an electronic format, for the express purpose of being downloaded by the Users. With regard to these files, and subject to the specific provisions of such document, copying such downloaded files and/or printing them is only allowed for the User's private use. Users are not permitted to distribute these files to any third parties, including via e-mails, printed versions, distribution on any tangible medium and by making these files available on a server, whether on a public or a private network.
All extracts ("short quotation" as defined by French case law) from the WebSite content shall indicate the title of the document or the URL of the WebSite where the document is made available, the name of the author and, as appropriate, its date of publication and number and the name of the Law Firm.
5) Other provisions
The WebSite is strictly limited to personal use by the Users.
The WebSite and all documents, information and data provided therein are intended to provide non-exhaustive, general information related to the Law Firm and its areas of expertise. The WebSite and all documents, information and data provided therein cannot be interpreted as providing legal advice, canvassing, a solicitation and/or an offer of services.
Users are liable for any use of the information contained therein and the Law Firm shall not be held responsible for any damages, direct, indirect or otherwise, arising from the use by such Users of the information provided on the WebSite.
The Law Firm does not warrant the continuity of access to the WebSite.
Third parties websites, their content and/or documents available through hypertext links included on the WebSite or in the documents downloadable from the latter are under the sole responsibility of their author and/or right owner and the Law Firm shall not be held liable (content and technical specifications).
The WebSite publisher makes his best efforts to provide available and valid information and/or tools. However, he could not be held responsible for errors, temporarily unavailable information and/or the presence of viruses on the WebSite.
While visiting the WebSite, cookies could automatically be set up on the User's web browsers.
Cookies are simple pieces of data unable to identify the User. They are only used to differentiate users and to maintain data related to the User during its navigation on the WebSite.
